Terms & Conditions of Hire – Putt 4 Fun V1 16-05-19
1.1 The "Client" means the person/s, organisation or company booking the equipment, or entertainment pieces with the "Company".
1.2 The "Company" means Putt 4 Fun – the supplier of equipment.
1.3 'Dry' hire is the hire of equipment for the 'client' to operate and supervise themselves.
1.4 'Wet' hire is the hire of equipment or entertainment accompanied by a representative of the 'company' to supervise use of the booked equipment or entertainment.
2.1 All hire equipment remains the property of the company at all times.
2.2 By placing an order with us either verbally or via e-mail, it is deemed that the customer has read, understood, fully agreed to and is bound by all our terms and conditions of hire. These are available at www.putt4fun.co.uk with copies also provided upon written request.
2.3 By accepting the terms and conditions of hire you agree that you are solely responsible for the hire equipment at all times, throughout the duration of the hire period, until the items are collected from your venue / location.
2.4 In the event of traffic or other uncontrollable circumstances preventing us from being able to fulfil our contracted obligations on a ‘wet’ hire, our liability shall be limited to a refund of any monies paid in relation to the contracted event or a pro rata reduction in the hire fee in the event of delayed start. No further compensation will be paid irrespective of any loss of earnings.
3.1 All hires are subject to payment in full at least 28 days prior to the event date.
3.2 Terms for approved account clients will be strictly 30 days from invoice date unless agreed in writing by the company.
3.3 Advertised prices are subject to change without prior notification and all quotations are valid for 30 days.
3.4 The company reserves the right to implement a late payment fee in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
4.1 Any cancelled order is subject to the following cancellation charges:
If cancelled less than 28 days prior to event: 25% cancellation fee retained by Putt 4 Fun.
If cancelled less than 14 days prior to event: 50% cancellation fee retained by Putt 4 Fun.
If cancelled 7 days prior to event: 100% cancellation fee retained by Putt 4 Fun.
Any initial deposit amount is non-refundable.
5.1 The company reserves the right to substitute hired equipment with equipment of a similar type and value without notice in the event of previous damage or loss of booked equipment.
5.2 At point of delivery, the hirer needs to inspect and accept the equipment in good condition. Any complaints relating to the equipment must be made within 2 hours of receipt of delivery. The company will not be held responsible if such inspection has not been carried out by the hirer. The company delivery note will log this, which must be signed upon receipt of equipment (subject to good condition being agreed by the client and the company).
5.3 All goods remain the property of the company at all times.
5.4 The company reserve the right to amend or alter any product specifications without prior notice.
5.2 All sizes quoted are approximate and will vary.
Site Location, Facilities and Conduct
6.1 Hired equipment will be set up in one location only as agreed on arrival and will not be moved once unloaded.
6.2 The company reserve the right to refuse delivery if the venue or site is deemed to be unsuitable by our delivery personnel or if the client has failed to notify the company of any delivery obstructions such as stairs or excessive loading distances from our vehicle to the installation site. In such a case, no refund will be given and the full hire fee will be due.
6.3 The company reserves the right to cease operation and remove hired equipment from site if at any time a representative of the company feels that guests or clients conduct endangers the safety of the guests, clients, themselves or the safety of the hired equipment. In such cases, no refund will be given and full contracted fees will be due to the company.
Standard Hire Period
7.1 Standard delivery and collection times are agreed on a hire by hire basis.
7.2 In the event of a supervised ‘wet’ hire, the representatives from the company will remain at the venue for the duration of the hire and all equipment removed at the agreed event time.
7.3 Hired items must be available for collection at the delivery address, or alternative address if notified at point of booking. Delays to the return of equipment will be charged accordingly. Additional charges for hire will be passed on in cases whereby the hire equipment is not available for collection during the agreed collection window – see 7.1.
7.4 Any person signing a delivery/collection note on behalf of the hirer is deemed to be authorised to do so.
7.5 Any extension to the agreed hire period will be charged at cost agreed in writing between the client and company.
Liability and Insurance
8.1 The company’s liability insurance covers both use of the equipment whilst booked on “dry” hire (unsupervised by the company) and 'wet' hire (supervised by a representative of the company).
8.2 The client agrees to indemnify the company for any damage or theft of the company’s equipment whilst on hire.
8.3 The company accept no liability for any damage or loss of personal property and or any injury arising from the use of the hired equipment.
8.4 The company accepts no liability arising from injury caused by the acts or omissions of any participant towards another participant.
8.5 Any equipment booked on 'dry hire' is covered by the company’s insurance policy and is subject to the client ensuring they have a designated person present at all times, as well as the equipment being kept safely and properly at all times.
8.6 In certain cases, the company has the right to request a damages deposit at the time of booking of £250, which will be retained by the company, and returned in full if all equipment is returned in its original state.
8.7 All equipment will be checked back into the company post event. Breakages, missing parts and damages to the hire items will be charged according to the full replacement value.
